Terms of Service

These Terms of Service ("Terms") set out the rules for anyone who visits, browses or interacts with the GestWave website (the "Site"), including any subdomains operated by ARP Group Ltd. They do not apply to the use of GestWave software products, which are governed by separate commercial agreements signed with each client.

We may update these Terms from time to time. Changes take effect when published on this page with a revised "Last updated" date. Continued use of the Site after changes means you accept the updated Terms.

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that breaches any applicable local, national or international law or regulation.
• Engage in any activity that could damage, disable, overburden or impair the Site or interfere with any other party's use of the Site.
• Attempt to gain unauthorised access to any part of the Site, server or network connected to the Site.
• Introduce or transmit any viruses, malware or other malicious code.
• Use any automated system (including robots, spiders or scrapers) to access the Site in a manner that sends more request messages than a human can reasonably produce.
• Reproduce, duplicate, copy, sell, resell or exploit any portion of the Site without express written permission.

All content on the Site — including text, graphics, logos, icons, images, software and source code — is the property of ARP Group Ltd or its licensors and is protected by copyright, trademark and other intellectual property laws. You may view and print pages from the Site for your own personal, non-commercial use, provided you do not modify the content and retain all copyright notices.

The "GestWave" name and logo, as well as product names such as "GestWave Edupro" and "GestWave VLE", are trademarks of ARP Group Ltd. You may not use these marks without our prior written consent.

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. ARP Group Ltd does not warrant that:

• The Site will be uninterrupted, timely, secure or error-free.
• The results obtained from using the Site will be accurate or reliable.
• Any errors in the Site will be corrected.

To the fullest extent permitted by law, ARP Group Ltd disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by applicable law, ARP Group Ltd and its directors, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, arising out of or relating to:

• Your access to or use of, or inability to access or use, the Site.
• Any content obtained from the Site.
• Any unauthorised access to or alteration of your transmissions or data.
• Any statements or conduct of any third party on the Site.

This limitation applies whether the claim is based on warranty, contract, tort or any other legal theory, and even if ARP Group Ltd has been advised of the possibility of such damages.

You agree to indemnify and hold harmless ARP Group Ltd, its affiliates, officers, agents and employees from any claim or demand made by any third party arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another.

The Site may contain links to third-party websites or services that are not owned or controlled by ARP Group Ltd. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party sites. By using the Site, you expressly release ARP Group Ltd from any liability arising from your use of any third-party website.

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use and protect your personal data. Please review these documents before using the Site.

These Terms apply only to the public website. Access to and use of GestWave software products — including GestWave Edupro, GestWave VLE and any other platform modules — is governed exclusively by separate commercial agreements ("Service Agreements") executed between ARP Group Ltd and each client. Those agreements set out the specific terms of licensing, data processing, support, service levels and liability applicable to each subscription.

If you are interested in subscribing to GestWave products, please contact us to receive the relevant Service Agreement for your organisation.

These Terms shall be governed by and construed in accordance with the laws of Malta. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malta.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

We may revise these Terms at any time by updating this page. We encourage you to review the Terms periodically. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
